1. General Terms and Conditions of Sale (GTC)

1. Acceptance of Terms

By accessing the website https://products.frandevs.fr/ (the “Site”) and purchasing the GoodFramePlus software (the “Software”), you agree to be bound by these General Terms and Conditions of Sale (the “GTC”). If you do not agree to these GTC, you must not use the Site or purchase the Software.

2. The Software

The Software, GoodFramePlus, is a digital product sold by FranDevs (“We”, “Our”) that allows users to add frames, signatures, logos, and watermarks to digital photos, with batch processing capabilities.

3. Software License for Use

a. License Grant 
Upon purchasing the Software, We grant you a limited, non-exclusive, non-transferable, and revocable license to install and use the Software on a single (1) computer, solely for your internal personal or business use. 

b. Term 
The purchase price of €20 incl. VAT includes the Software license and all major and minor updates for a period of two (2) years from the date of purchase. 

c. Restrictions
You agree not to:
i. Copy, modify, or create derivative works of the Software.
ii. Rent, lease, sell, sublicense, assign, distribute, or otherwise transfer the Software. iii. Reverse engineer, decompile, or disassemble the Software. iv. Use the Software for any illegal or unauthorized purpose.

4. Price, Payments, and Refund Policy

a. Price and Payment
The price of the Software is that indicated on the Site (currently €20 incl. VAT), all taxes included. All payments must be made via the third-party payment service providers designated on the Site. We are not responsible for issues arising from the use of these third-party services.

b. Refund Policy (Digital Product)
i. General Principle: Due to the digital nature of the Software, delivered immediately after purchase, all sales are generally final and non-refundable.
ii. Refund Eligibility (Exceptions): A refund can only be considered under the following strict conditions: * Demonstrable Non-Functionality: You are eligible if the Software is confirmed to be demonstrably non-functional on your announced operating system, despite meeting minimum technical requirements. * Prior Support Attempt Required: Before requesting a refund, you must contact Our support team (via contact@FanDevs.fr) within fourteen (14) days from the date of purchase. You must actively cooperate with us to diagnose and attempt to resolve the technical issue. * Failure to Resolve: If, after a reasonable effort, our support team is unable to correct the proven issue preventing the Software from operating, a refund will be processed.
iii. Exclusions (No Refund Will Be Granted): Refunds will not be granted for: change of mind, lack of use, issues due to incompatibility with specific hardware or third-party software not mentioned in the minimum requirements, expiration of the included update period, or in case of violation of these GTC.

c. Principle of the Right of Withdrawal

In accordance with the provisions of Article L. 221-18 of the Consumer Code, the Customer generally has a period of fourteen (14) clear days to exercise their right of withdrawal from the conclusion of the contract, without having to provide reasons or bear any costs other than those provided for in Articles L. 221-23 to L. 221-25.

d. Exclusion of the Right of Withdrawal (Digital Content)

The Customer is expressly informed that, in accordance with Article L. 221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not provided on a tangible medium (which includes software licenses and downloads). The Customer expressly waives their right of withdrawal once:

  1. The execution of the supply of the digital content (download or activation of the license key) has begun.

  2. The Customer has given their prior express consent for the execution to begin before the end of the 14-day withdrawal period.

  3. The Customer has acknowledged that they will lose their right of withdrawal by the effect of this consent and the commencement of execution.

e. Refund Procedures
In cases where the right of withdrawal can be exercised (for example, if the license key has not been provided or if the software has not been downloaded/activated), the Company will process the refund using the same means of payment as used by the Customer for the initial transaction, within fourteen (14) days following the receipt of the notification of withdrawal.

5. Intellectual Property

The Software, the Site, and all its content (including text, graphics, logos, and features) are the property of FranDevs and are protected by copyright, trademark, and other intellectual property laws.

6. Disclaimer of Warranties

The Software is provided “AS IS,” without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or meet your specific requirements.

7. Limitation of Liability

In no event shall FranDevs be liable for any indirect, incidental, special, consequential, or punitive damages, including any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your use or inability to use the Software; (b) any unauthorized access to or use of our servers and/or any personal information stored therein.

8. Governing Law and Jurisdiction

These GTC are governed by and construed in accordance with French law. You agree that any legal action or proceeding shall be brought exclusively in the competent courts of [Your City/Region, e.g., Grenoble, France].
